In practice, this means that shops in Montenegro may soon be allowed to operate on Sundays, which has not been the case for more than six years.
As a reminder, the amendments to the Law on Internal Trade introducing the non-working Sunday were adopted by the Montenegrin Parliament in June 2019, and the first non-working Sunday in retail stores was October 20th of the same year.
The review of the constitutionality of the non-working Sunday, requested by the Union of Employers of Montenegro, took more than six years.
The Court found that the provision violates the freedom of entrepreneurship guaranteed by the Constitution, as well as the constitutional principle of equality before the law, since one group of entrepreneurs/retailers was allowed to operate on Sundays and on public and other holidays, while another group was prohibited from doing so, the Constitutional Court announced.
