The Venice Commission’s Visit to Serbia Over the Package of Judicial Laws

A delegation of the Venice Commission of the Council of Europe is on a two-day working visit to Serbia following the recent adoption of a package of amendments to judicial laws. The delegation met with representatives of both the ruling majority and the opposition.

There were no official statements from either side, but unofficially it was learned that the opposition welcomed the fact that the meeting was held earlier than initially planned - rather than in June - which they interpreted as a positive signal that their demands might be taken into consideration.

They are calling for the repeal of the amendments to judicial laws adopted by the National Assembly in January, following a proposal by MP Ugljesa Mrdic.

There are various scenarios regarding the next steps, including the possibility that the Constitutional Court may assess the constitutionality of the amendments, that the law could be reverted to its previous version, or that the amendments may remain in force.

The Venice Commission came to Serbia at the request of the Speaker of the National Assembly, Ana Brnabic, who submitted the request back in February, although the visit was carried out earlier than originally announced.

It is important to note that the Venice Commission is an expert advisory body of the Council of Europe, which provides recommendations for aligning legislation in the fields of democracy, human rights, and the judiciary with European standards.
